Terms of Service

1. Acceptance of Terms
By accessing or using the SpotKare platform ("Service"), operated by [Company Name Pvt. Ltd.] ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a therapy centre, you represent that you have authority to bind that organisation.
2. Definitions
- Service: The SpotKare web application and all associated APIs, documentation, and support.
- Centre: A therapy centre organisation that subscribes to the Service.
- User: Any individual who accesses the Service — including centre administrators, branch administrators, therapists, and parents.
- Centre Data: All data entered into the Service by or on behalf of a Centre, including child records, session notes, and reports.
3. Account Terms
Centre administrators are responsible for managing user accounts within their organisation. You must provide accurate information, maintain the confidentiality of login credentials, and promptly notify us of any unauthorised access. Each user account is for a single individual and must not be shared.
4. Service Description
SpotKare provides a multi-tenant platform for managing autism therapy operations, including: scheduling, session recording, progress tracking, attendance management, skill-domain assessments, billing, and parent communication. Each Centre's data is logically isolated from other tenants.
5. Subscription & Payment
Subscription plans and pricing are communicated during onboarding. Payment is currently accepted via cash or bank transfer. Online payment options may be introduced in the future. Failure to pay within the agreed terms may result in suspension of access. All fees are exclusive of applicable taxes unless stated otherwise.
6. Data Ownership
Centres retain full ownership of their Centre Data. We do not claim any intellectual property rights over data you enter into the platform. Therapy records, session notes, and child profiles belong to the Centre. We process Centre Data solely to provide and improve the Service.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to other tenants' data
- Reverse engineer, decompile, or disassemble the Service
- Upload malicious code or interfere with the Service's operation
- Share login credentials or allow unauthorised users to access the platform
- Use the Service to store data unrelated to therapy centre operations
8. Intellectual Property
The Service, including its source code, design, features, and documentation, is the intellectual property of [Company Name Pvt. Ltd.]. Your subscription grants a non-exclusive, non-transferable licence to use the Service for your therapy centre operations during the subscription term.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of planned maintenance where possible.
10. Limitation of Liability
To the maximum extent permitted by Indian law, [Company Name Pvt. Ltd.] shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service. Our total liability shall not exceed the fees paid by the Centre in the twelve months preceding the claim.
11. Termination & Data Export
Either party may terminate the subscription with 30 days' written notice. Upon termination, the Centre may request a full export of their Centre Data within 90 days. After the 90-day period, all Centre Data will be permanently deleted. We may terminate accounts immediately for violation of these Terms.
12. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.
